Statutory Requirements: |
Membership includes: a chairperson, to be nominated by the Minister (s.103(1)(a)); at least two deputy chairpersons to be nominated by the Minister (s.103(1)(b)); as many community members as are necessary to deal with the workload of the Board, to be nominated by the Minister (s.103(1)(c)); as many officers of the Public Sector agency of which the CEO is the chief executive officer as are necessary to deal with the workload of the Board, to be appointed by the CEO; and as many police officers as are necessary to deal with the workload of the Board, to be appointed by the Commissioner of Police. Section 103(2)(a) the Minister must not nominate a person as the chairperson unless the person is a serving or retired judge of the Supreme or District Courts. Section 103(3) the Minister must not nominate a person as a deputy chairperson unless the person has, in the Minister's opinion, extensive or special knowledge of matters involved in the performance of the Board's functions. Section 103(4) the Minister must not nominate a person as a community member unless the Minister is satisfied: (a) that the person is able to make an objective and reasonable assessment of the degree of risk that the release of a prisoner would appear to present to the personal safety of people in the community or of any person in the community; and (b) the person must have one or more identified attributes. Section 103(5) at all times the Board must contain at least one community member who has a knowledge and understanding of the impact of offences on victims, and an Aboriginal person with a knowledge and understanding of Aboriginal cultural local to this State. |

Requirements: |
Section 103(6) states: on appointing a departmental member of the Board, the CEO or the Commissioner of Police, as the case may be, must give written notice of the appointment to the person appointed and to the registrar of the Board. |
